Madonsela happy with court judgement on “reckless” Zuma

The woman of the moment, former Public Protector Thuli Madonsela has welcomed Wednesday’s court ruling on the State Capture report.

Madonsela says that the judgment made by Judge Dunstan Mlambo was in line with her own view of how President Jacob Zuma dealt with the report.

“If someone says your house is burning, honestly, you’ve got to sort that out. Find out [if] it is true,” Madonsela told reporters.

Her recommendations after her investigation into state capture were found by the court to be wise, necessary, rational and appropriate and, in the process, Zuma’s appeal against the report was dismissed by Judge Mlambo.

The onus now falls on Zuma to set up a commission of inquiry into state capture within 30 days which, as per Madonsela’s proposed remedial action, will be headed by a judge appointed by Chief Justice Mogoeng Mogoeng as opposed to the president.

Should Zuma take issue with the judgement, Madonsela says he has a right to appeal if he feels it was unlawful and that his rights were violated.

Madonsela says Zuma should have sprung into action and called an investigation the moment when former deputy minister of finance Mcebisi Jonas made allegations that he had been offered R600 million in cash by the Gupta family in the now infamous Saxonworld.

She feels it was irresponsible for the president to let such allegations stew and he needed to take into account the effect such serious claims have on the country

“Every day we lose, we are losing evidence and this is becoming a cold case and by the time we investigate, lots of the evidence, if not all, will be lost,” she said.

“I think it is time that people in government reflected and pause after a decision has been made by the Public Protector or the courts.

“Increasingly people just decide to take a matter on review within minutes of a decision being made and that gives me a sense that people do not apply their minds.”

Zuma however might not be too keen to lodge another appeal as Judge Mlambo also ordered that the legal costs which have accrued from his challenging the report come fro his own pocket rather than the public purse.
